If you subscribed to a Verizon Wireless Family SharePlan between May 11, 2002 and May 10, 2006, you could get benefits and may be affected by a class action settlement.
Welcome to the Verizon FSP class action website. This website is an informational website for Verizon Wireless customers who are interested in learning about the settlement reached by the parties in the case of Demmick, et al. v. Cellco Partnership d/b/a Verizon Wireless, United District Court for the District of New Jersey Case No. 06-2163 (JLL).
On October 13, 2014, a settlement was reached with Verizon Wireless in a class action lawsuit claiming that Verizon Wireless improperly: (1) billed Family SharePlan customers whose plans provided for different per-minute rates for "after-allowance" minutes used by different phone lines; and (2) charged Family SharePlan customers for "In-Network" or "In-Family" calling when these calls should have been free under the customers' plans. Verizon Wireless disputed these claims.
On March 30, 2015, the District Court granted final approval to the proposed settlement. You can access a copy of the Court's Final Approval Orders by clicking on the "Court Documents" tab that is located in the upper left corner of this page.
There were nine people claiming to be class members who objected to the settlement. The District Court overruled all of the objections to the settlement when the Court issued its orders granting final approval to the settlement. However, seven of those objectors filed appeals challenging the Court's Final Approval Orders. Until those appeals could be resolved, the Settlement Administrator was not able to commence the settlement and claims administration process that needs to be completed before benefits can be distributed to the class members.
In late August of 2016, the appeals were finally resolved and dismissed. The Settlement Administrator is now engaged in the process of verifying the claim forms that were submitted and calculating the settlement benefits to be distributed to the class members. At present, the Settlement Administrator projects that settlement benefits will be distributed to class members on the following dates:
December 27, 2016: PINs were issued to all members of the "In-Network" Settlement Class.
January 2017: Bill credits will be applied to the accounts of all class members who are still Verizon Wireless customers. Bill credits will appear on customer accounts as each cycle bills throughout the month of January.
February 27, 2017: Checks will be mailed to all class members who are no longer Verizon Wireless customers.
